These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the Onelist.shop website, mobile application, and any related services (collectively, the "Platform"). "Platform" refers to the Onelist.shop website and any future mobile applications. 1.2. "Provider" or "Business Owner" refers to any individual or entity that lists their services, products, or business details on our Platform. 1.3. "Customer" or "User" refers to anyone who visits the Platform to search for, review, or contact Providers. 1.4. "Listing" refers to the business profile, contact details, catalog, and information published by a Provider on the Platform. 1.5. "Lead" refers to an inquiry or message sent by a Customer to a Provider through the Platform. --- 2. PLATFORM SERVICES & FUTURE EXPANSION 2.1. Current Services: Onelist.shop is a local services directory that connects Customers with verified local professionals, contractors, and service Providers. We currently offer free business listings and direct lead generation features. 2.2. Future Features (Future-Proofing): The Company is continuously evolving. We reserve the right to introduce new features, including but not limited to: a) Payment Gateways: Integration of third-party payment processors (such as Razorpay, Open Money, Stripe, etc.) for subscription plans, premium listings, or direct booking fees. b) Advanced SEO & Marketing: Enhanced Search Engine Optimization (SEO) tools to rank Provider profiles on Google and other search engines. c) Direct Booking Systems: Facilities for Customers to book vehicles, trucks, or temporary drivers directly through the Platform. 2.3. No Guarantee of Results: While we use advanced SEO techniques to index your business on Google, we do not guarantee specific search engine rankings, traffic volume, or business leads. --- 3. USER & PROVIDER REGISTRATION 3.1. Eligibility: You must be at least 18 years old and capable of forming a binding contract to use this Platform. 3.2. Account Accuracy: Whether you are logging in via Google Auth or Email/Password, you agree to provide accurate, current, and complete information during the registration and KYC processes. 3.3. Account Security: You are responsible for safeguarding your login credentials. You must notify us immediately of any unauthorized use of your account. 3.4. Identity Verification: The Company reserves the right to hold Provider accounts in a "Pending" status until manually verified by our Admin team. We may ask for legal documents to verify business authenticity to maintain a spam-free environment. --- 4. PROVIDER OBLIGATIONS & CONDUCT If you list your business on Onelist.shop, you agree to the following strictly enforced rules: 4.1. Accuracy of Listings: You must ensure that your business name, contact details, banners, logos, and service descriptions are 100% accurate and legal. 4.2. Prohibited Content: You may not upload fake reviews, misleading prices, illegal services, adult content, or copyrighted material belonging to others. 4.3. Customer Interaction: You agree to treat all Leads and Customers generated through our Platform with respect, professionalism, and honesty. Breaking a customer's trust is against our core values and may result in immediate profile suspension. 4.4. Independent Contractor Status: Providers are independent contractors. Onelist.shop is not an employer, partner, or joint venture of any Provider. We simply provide the digital bridge between you and the customer. --- 5. REVIEWS, RATINGS & USER-GENERATED CONTENT 5.1. Authenticated Reviews: To prevent spam and maintain a high-trust ecosystem, Customers must log in via their Google/Email accounts to post a review. 5.2. Honest Feedback: Customers agree to post reviews based strictly on their actual, genuine experiences with the Provider. 5.3. Content Removal: The Company acts as an intermediary. We reserve the right (but not the obligation) to remove reviews that contain abusive language, hate speech, or are proven to be maliciously planted by competitors. 5.4. License to Use Content: By posting reviews, banners, or logos on our Platform, you grant us a non-exclusive, worldwide, royalty-free license to display, use, and promote this content for marketing purposes (including Facebook, Google Ads, and promotional videos). --- 6. FEES, PAYMENTS & REFUNDS (APPLICABLE FOR FUTURE PAID SERVICES) 6.1. Free Tier: Basic listing and lead generation features are currently provided free of charge to help local businesses grow. 6.2. Premium Services: In the future, the Company may introduce Premium, Professional, or Enterprise subscription plans. You will be notified before any charges are applied. 6.3. Payment Processing: All online transactions will be securely processed through authorized third-party gateways. Onelist.shop does not store your credit card or bank account details. 6.4. Refund Policy: Specific rules regarding refunds for premium subscriptions will be detailed in a separate "Refund Policy" document. Generally, digital directory listing fees are non-refundable once the profile is active and indexed. --- 7. SEARCH ENGINE OPTIMIZATION (SEO) & VISIBILITY 7.1. Public Visibility: By creating a public profile, you acknowledge and agree that your business information (Name, Services, City, Reviews) will be indexed by search engines like Google, Bing, and Yahoo. 7.2. Marketing Use: We may use your business listing data in our digital marketing campaigns across social media platforms to drive more traffic to your profile. --- 8. INTELLECTUAL PROPERTY RIGHTS 8.1. Platform Ownership: All code, databases, design elements, UI/UX, and the YASCARYME / Onelist.shop trademarks are the exclusive property of the Company. 8.2. Restriction on Use: You may not scrape, copy, reverse-engineer, or distribute any part of the Platform without our explicit written permission. --- 9. DISCLAIMERS & LIMITATION OF LIABILITY 9.1. "As-Is" Basis: The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. 9.2. Third-Party Disputes: Onelist.shop is not responsible for the actual quality of services provided by the Business Owners. Any dispute regarding the service, payment, or behavior between a Customer and a Provider is strictly between those two parties. 9.3. Technical Issues: While we strive for 100% uptime, we are not liable for temporary downtime due to server maintenance, Firebase updates, or domain DNS propagation delays. 9.4. Liability Cap: To the maximum extent permitted by Indian law, the Company's total liability to you for any claims arising from the use of the Platform shall not exceed the amount you paid to us (if any) in the past three (3) months. --- 10. INDEMNIFICATION You agree to indemnify, defend, and hold harmless YASCARYME PRIVATE LIMITED, its directors, employees, and AI developers from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any third-party rights. --- 11. TERMINATION OF ACCOUNT 11.1. By the User: You may stop using the Platform at any time. Providers can request account deletion by contacting Admin. 11.2. By the Company: We reserve the right to block, suspend, or terminate any account (via our Admin dashboard) immediately, without prior notice, if we determine that a user has violated these Terms, engaged in fraudulent activities, or breached customer trust. --- 12. GOVERNING LAW & JURISDICTION 12.1. These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000. 12.2. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Howrah, West Bengal, India. --- 13. CHANGES TO TERMS We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Effective Date" at the top of this page.
